Litigation
The Firm generally litigates issues related to: (1) setting aside wills, trusts or other transfer instruments, (2) probate and trust disputes, (3) disputes related to a breach of fiduciary (i.e., trustee, attorney-in-fact or personal representative) duties and (4) litigation regarding guardianship issues.
Mr. Linde is very familiar with these types of disputes. In 1994, while Mr. Linde’s father was dying of cancer, Mr. Linde’s father married a woman three weeks before he died. During the last few days of his life, the new wife was able to convince Mr. Linde’s father, while on extensive pain medication, to sign documents transferring all his assets to the new wife (whose parents were multimillionaires). Mr. Linde spent the next year of his life researching all possible issues related to capacity, undue influence, fraud et cetera. Thus, Mr. Linde knows how it feels to watch a person without morals manipulate a loved one for the purpose of gaining money.
Since 1994 Mr. Linde has represented many different individuals with probate and trust disputes. Sometimes the best answer is to immediately file a lawsuit. However, for every time Mr. Linde has counseled an individual to file a lawsuit, he has probably counseled two individuals to attempt to resolve the problem other ways.
Mr. Linde has a real passion for his work in this area. The truth is that many people are greedy and will lie, cheat and steal to get their hands on an older person’s wealth. Nothing provides Mr. Linde with more pleasure than to see a greedy person brought to justice.
